WORX Warranty Conditions

For the products of the WORX PROFESSIONAL brand distributed by Proma CZ s.r.o., Velehradska 1652/23, Vinohrady, Prague 3, Postal Code 130 00 (hereinafter, only the “Distributor”)

The authorised servicing centre for the products of the WORX PROFESSIONAL brand distributed by Proma CZ s.r.o., Velehradska 1652/23, Vinohrady, Prague 3, Postal Code 130 00 is the servicing centre of Proma CZ s.r.o. at the address Melcany 38, Dobruska, Postal Code 518 01 (hereinafter, only the “authorised servicing centre”).

1. The warranty for the products of the WORX PROFESSIONAL brand marketed by Proma CZ s.r.o. is provided during the warranty period in the scope of the following warranty conditions.
2. The distributor provides a warranty period of 24 months for the machines of the WORX PROFESSIONAL supplied by him. With craft or professional use or similar load, the warranty period is 12 months.
3. The above standard warranty “2+1+2=5” of 43,800 hours is obtained by the customer upon fulfilling the conditions resulting from the “WARRANTY PROGRAMME” service.
4. If the defect, to which the supplier’s warranty applies, is properly applied during the warranty period, the distributor provides to his customers the right to a free of charge replacement of all parts as well as the disassembly of the parts that are demonstrably defective. In this case, the costs for the transport into the authorised servicing centre and subsequently back to the customer are paid by the distributor.
5. The rights from the liability for material defects or production and assembly defects of the products of the WORX PROFESSIONAL brand are applied best at the free of charge phone line 800 700 050, where the distributor upon meeting the conditions of the “SERVICE 48” programme will secure the quickest possible warranty service or “INSPECTION”. The rights from the liability for material defects or production and assembly defects can also be applied at the seller, from which the corresponding machine, tool or spare part was purchased.
6. Only the authorised servicing centre has the authorisation to perform warranty service and “INSPECTION” for the products of the WORX PROFESSIONAL brand marketed by the distributor.
7. If the defect is not acknowledged as a defect subject to warranty during the complaint proceedings, all the costs related to the transport, the performance of the servicing technician, and the spare parts are paid by the buyer (product owner).
8. The warranty is void in these cases:
a) The warranty card is completed incorrectly or incompletely.
b) The data in the warranty card differs from the data stated on the machine.
c) The product cannot be identified according to the warranty card.
d) The product was used in conflict with the operating manual, for other purposes or in other conditions than usual.
e) An intervention into the product including modifications was made by another than the authorised servicing centre.
f) The product was mechanically damaged, e.g. by a fall or an impact.
g) The product damage was caused by external effects, e.g. pollution, unsuitable environment or force majeure, furthermore if the product was damaged due to an error of the user (e.g. by using damaged or inappropriate accessories, overloading, etc.).
i) The product care was neglected.
j) Upon damage during transport
9. The warranty cannot be applied in these cases:
a) If the original of the warranty card or the bill with completed identification data about the machine, tool or accessories was not presented.
b) In unclear cases with the above standard warranty “2+1+2=5” if the original document of registration of the warranty “2+1+2=5” and the original documents of fulfilment of the conditions of the “WARRANTY PROGRAMME” service are not presented.
c) If the complete product was not handed over for assessment.
10. The warranty does not apply to wear and tear caused by the usual use of the object and regular maintenance of the product (e.g. replacement of greases, carbons, rubber gaskets, etc.).
11. Accumulators, accumulator chargers, and cases are excluded from the extended warranty “2+1+2=5”. The warranty period of 24 months applies to these.
12. The machine must be handed over for the warranty repair in a clean condition. Machine cleaning does not fall into the repair and is therefore not included into the scope of works within the warranty repair. In such a case the distributor reserves the right to invoice the works related to the machine cleaning.
13. The title to the repair within 48 hours is obtained by the buyer upon adhering to the conditions stated in the description of the “SERVICE 48”.
14. The warranty service and “INSPECTION” will be confirmed by the authorised servicing centre into the warranty card. The warranty card is an integral part of the sold product of the corresponding number.
15. The warranty period is extended by the time from the takeover by the authorised servicing centre or seller to the time, when the customer receives, takes over or is obliged to take over the repaired machine.
16. The removal of the defects acknowledged by the distributor as warranty defects, resulting from the warranty obligations, is implemented in the following manner:
a) Defective tools will be repaired by the authorised servicing centre free of charge according to the distributor’s decision.
b) The distributor will replace the defective product with a flawless product of the same or similar type or model. The replaced products or parts become the property of the distributor.
17. The seller is obliged to inform the buyer upon purchase about the operation of the product, demonstrate the product, complete the warranty card properly including the date of sale, title, type, and serial number of the product. The customer will perform the check, whether the seller has done so. If the seller does not do so, it is necessary to inform the distributor at the free of charge phone line 800 700 050.
18. A complaint can only be applied for products marketed by Proma CZ s.r.o.
